Unforeseen Circumstances
Ruck reserves the right to bill back for any unforeseen circumstances that significantly disrupt or alter delivery and service expectations.
Vendors

Address or Pickup Time Inaccuracies

A fee of $50 will be charged when delivery or pickup addresses and/or pickup times are incorrect, resulting in delays or confusion for Drivers.

Loading and Unloading Expectations

The agreed-upon unloading or loading fee applies.

An additional $50 fee will be charged for inaccuracies or missing information related to unloading.

Each additional hour of unloading beyond the agreed time will incur $35 per hour.

Defects

Ruck is not responsible for any pre-existing defects or damage to a product before it is loaded onto the Driver’s vehicle or trailer.

Incorrect Drop-Off Addresses

If the drop-off address provided is inaccurate and causes rerouting or delay, Ruck may bill the Vendor for associated costs, including driver time and mileage.

Returns

If a load must be returned due to Vendor error, the Vendor may be billed for the return trip, plus any additional labor or mileage costs incurred.

Damaged Vehicles

If the Vendor’s actions or negligence (e.g., improper loading, providing faulty equipment) result in damage to the Driver’s vehicle, the Vendor may be liable for related repair costs.

Pros
“Pros” refers to professional service providers or specialists involved in loading, unloading, installing, or otherwise handling cargo associated with a Ruck delivery.

On-Site Delays

If a Pro is delayed in preparing items for pickup or installation and causes the Driver to wait beyond a reasonable grace period (e.g., 30 minutes), a waiting fee may apply.

Equipment and Manpower Requirements

Pros are responsible for having adequate equipment (forklifts, dollies, etc.) and manpower for safe loading/unloading. If Ruck Drivers are forced to provide additional labor or encounter unsafe conditions, additional fees may be assessed to compensate for the extra effort or delays.

Changes to Service Scope

Any last-minute changes to loading/unloading scope, pick-up location, or assembly needs can result in additional fees. Ruck reserves the right to bill for added services or time.

Damages During Professional Services

If a Pro damages the cargo or Driver’s equipment while performing services (e.g., using the wrong tools, improper handling), the Pro may be liable for resulting costs or claims beyond what Ruck’s Guarantee covers.

Cancellations/No-Shows

In cases where Pros fail to show up or cancel late, Ruck may bill back fees associated with Driver travel time, missed delivery slots, or rescheduling.

Drivers
Drivers are independent contractors who partner with Ruck to fulfill delivery services.

Vehicle Readiness

Drivers must ensure their vehicles are properly maintained and suitable for the assigned load. Any mechanical failures or inability to complete the delivery due to lack of maintenance may result in the Driver bearing associated costs (e.g., towing, replacement vehicle).

Timeliness and No-Shows

If a Driver is significantly late (beyond a reasonable grace period) without prior notice or fails to show up, Ruck reserves the right to charge back any fees or losses incurred to the Driver, including potential credits to the Vendor or customer.

Improper or Incomplete Documentation

Drivers are required to document loads before departure and upon drop-off. Failure to follow proper documentation procedures may result in claims being denied, or the Driver being held responsible for unresolved damage disputes.

Damages or Liabilities

The Driver may be held responsible for cargo damage resulting from improper loading or securement if the Driver opted to assist or override Vendor/Pro loading procedures.

If the Driver causes damage to a Vendor’s property or product outside the scope of coverage provided by Ruck, the Driver may be liable for repair or replacement costs.

Non-Solicitation

Drivers must adhere to the terms of any applicable non-solicitation agreements with Vendors, Pros, or Ruck. Any attempt to establish a direct business relationship that circumvents Ruck could result in termination of the Driver’s partnership and potential legal action.

Adherence to Instructions

Drivers must follow all instructions provided by Ruck, including designated routes, pick-up/drop-off protocols, and agreed-upon loading/unloading responsibilities. Failure to adhere to these instructions may lead to additional fees or termination of partnership.

Late Cancellations

If a Driver cancels a scheduled delivery without sufficient notice, Ruck may pass along any resulting costs or inconveniences to the Driver, including compensation owed to the Vendor or end customer for disruptions.
